Palestinian Ministry of Foreign Affairs and Expatriates Welcomes Report of the UN Independent International Commission of Inquiry on the Genocide in Gaza
The Ministry of Foreign Affairs and Expatriates of the State of Palestine welcomes the report issued by the United Nations Independent International Commission of Inquiry, which unequivocally confirms that Israel, the unlawful occupying power, has committed the crime of genocide against the Palestinian people in the Gaza Strip through a deliberate and large-scale policy aimed at their systematic destruction.
The report confirms that Israel has committed acts constituting the core elements of the crime of genocide under the 1948 Convention, including mass killings, maintaining a suffocating siege and systematic starvation, the total destruction of civilian infrastructure, and the direct targeting of women and children. These findings constitute a stark warning under international law and expose the criminal nature of this war, which threatens to undermine the foundations of the entire international legal order. International law experts and independent investigators have unanimously agreed that what the Palestinian people in Gaza are enduring constitutes, beyond any doubt, a full-fledged crime of genocide, amid a growing international consensus on this undeniable reality.
The Ministry notes that the damning facts contained in the report build upon previous findings, including those of the International Court of Justice, and reveal an unprecedented level of brutality and determination to destroy the lives and existence of the Palestinian people – conduct that not only amounts to a fully-fledged crime of genocide, but also war crimes and crimes against humanity.
The situation in Gaza today portends a humanitarian catastrophe that cannot tolerate any complacency or delay, as Israel, the unlawful occupying power, continues to commit the gravest violations in blatant defiance of the rulings of the International Court of Justice and the will of the international community. This imposes a clear legal and moral obligation on all States Parties to the Geneva Conventions and the Convention on the Prevention of Genocide to act immediately and decisively.
Accordingly, the State of Palestine calls on the international community to assume its historic responsibilities without delay, and take practical and decisive measures to stop the ongoing genocide, provide international protection for the Palestinian people, end all forms of military and political support to Israel, the unlawful occupying power, and impose sanctions on it. The continuation of international silence in the face of these heinous crimes places the international community in a position of complicity and poses a grave threat to regional and international peace and security.

ترحب وزارة الخارجية والمغتربين لدولة فلسطين بالتقرير الصادر عن لجنة التحقيق الدولية المستقلة التابعة للأمم المتحدة، والذي اثبت بما لا يدع مجالا للشك ان اسرائيل، قوة الاحتلال غير الشرعي، قد ارتكبت جريمة الابادة الجماعية ضد ابناء شعبنا في قطاع غزة من خلال سياسة متعمدة وواسعة النطاق هدفت الى التدمير الممنهج للشعب الفلسطيني. ويؤكد التقرير ان الاحتلال ارتكب افعالا تشكل الركائز الاساسية لجريمة الابادة الجماعية وفقا لاتفاقية 1948، بما في ذلك القتل الجماعي، الابقاء على الحصار الخانق والتجويع الممنهج، التدمير الشامل للبنية التحتية المدنية، واستهداف الاطفال والنساء بصورة مباشرة. هذه النتائج تشكل انذارا صارخا على مستوى القانون الدولي، وتكشف طبيعة الحرب الاجرامية التي تهدد بزعزعة اسس النظام القانوني الدولي برمته. اذ اجمع خبراء القانون الدولي والمحققون المستقلون على ان ما يتعرض له شعبنا في غزة يرقى دون أدنى لبس الى جريمة ابادة جماعية مكتملة الاركان، في ظل اجماع دولي متزايد حول هذه الحقيقة الماثلة.
وأشارت الخارجية الى ان ما ورد في التقرير من حقائق دامغة، يراكم على التقارير السابقة، ومخرجات محكمة العدل الدولية، ويعكس مستوىً غير مسبوق من الوحشية والاصرار على تدمير حياة الفلسطينيين ووجودهم، الامر الذي يرقى الى جريمة ابادة جماعية مكتملة الاركان وجرائم حرب وجرائم ضد الانسانية. ان الوضع في غزة اليوم ينذر بكارثة انسانية لا تحتمل اي تهاون او تأخير، حيث يواصل الاحتلال، قوة الاحتلال غير الشرعي، ارتكاب أبشع الانتهاكات في تحد سافر لقرارات محكمة العدل الدولية ولإرادة المجتمع الدولي، ما يفرض مسؤولية قانونية واخلاقية على كل الدول الاطراف في اتفاقيات جنيف واتفاقية منع الابادة الجماعية للتحرك الفوري والعاجل.
وعليه، تدعو دولة فلسطين المجتمع الدولي الى تحمل مسؤولياته التاريخية دون ابطاء، واتخاذ اجراءات عملية وحاسمة لوقف الابادة الجماعية الجارية، وتوفير الحماية الدولية للشعب الفلسطيني، ووقف جميع اشكال الدعم العسكري والسياسي لإسرائيل، قوة الاحتلال غير الشرعي. وفرض العقوبات على سلطة الاحتلال. ان استمرار الصمت الدولي ازاء هذه الجرائم المروعة يضعها موضع المتواطئ بما يشكل تهديدا خطيرا للسلم والامن الدوليين.
