Welcoming UN Special Rapporteur's New Report "Gaza Genocide: A Collective Crime"
The Ministry of Foreign Affairs and Expatriates of the State of Palestine welcomes the latest report of the United Nations Special Rapporteur on the situation of human rights in the Palestinian territories occupied since 1967, Ms. Francesca Albanese, entitled “Gaza Genocide: A Collective Crime”.
This report constitutes a courageous document of truth, a principled articulation of law, evidence, and integrity. It exposes the reality of the ongoing genocide against the Palestinian people in Gaza and the broader framework of settler-colonial domination, prolonged military occupation, and apartheid imposed by Israel, the illegal occupying Power.
Decades of impunity and double standards have emboldened Israel to commit systematic and grave violations of international law. The failure of influential States to uphold their legal obligations, by providing diplomatic cover, political protection, and military and economic support, has turned this genocide into a collective crime.
The Ministry commends Special Rapporteur Francesca Albanese for her professionalism, integrity, and moral courage in fulfilling her mandate despite relentless political pressure and smear campaigns aimed at silencing the truth and shielding perpetrators.
The State of Palestine affirms that this report should mark a turning point for the international community. The genocide in Gaza is not only a tragedy for the Palestinian people, but a test of the international system’s ability to uphold justice, equality, and the rule of law.
States must move beyond words and take concrete measures to meet their obligations under international law. It is no longer acceptable to manage the consequences of Israel’s occupation and apartheid; it is time to end them.
The New York Declaration on the Peaceful Settlement of the Question of Palestine provides a clear and actionable roadmap to end the genocide in Gaza, ensure accountability for grave international crimes, and secure the recognition and realization of an independent, sovereign, and contiguous State of Palestine on the 1967 borders, with East Jerusalem as its capital. The State of Palestine urges all States to implement the New York Declaration’s commitments, including the imposition of sanctions and arms embargoes, support for international justice mechanisms, and the cessation of all forms of complicity and political, military, and economic support that have enabled Israel’s impunity and brazenness in committing its crimes and violations.

ترحب وزارة الخارجية والمغتربين بالتقرير الصادر عن المقررة الخاصة للأمم المتحدة المعنية بحالة حقوق الإنسان في الأرض الفلسطينية المحتلة منذ عام 1967، فرانشيسكا ألبانيز، بعنوان "إبادة غزة: جريمة جماعية". حيث يعتبر هذا التقرير في غاية الأهمية لما يتضمنه من حقائق وبيانات تعكس واقع الاحتلال الإسرائيلي وجرائمه المستمرة والموثقة قانونياً بالأدلة والبراهين، إذ يكشف التقرير بوضوح التواطؤ والدعم الدولي في ارتكاب جريمة الإبادة الجماعية ضد الشعب الفلسطيني في قطاع غزة، والإطار الأوسع لسياسات الاستعمار الاستيطاني والاحتلال العسكري طويل الأمد، ونظام الفصل العنصري الذي تفرضه إسرائيل، القوة الاحتلال غير الشرعي.
فقد أدت عقود من الإفلات من العقاب وازدواجية المعايير إلى تشجيع إسرائيل، السلطة القائمة بالاحتلال، على ارتكاب انتهاكات جسيمة ومنهجية للقانون الدولي، وإن تقاعس بعض الدول المؤثرة عن الوفاء بالتزاماتها القانونية، من خلال توفير الغطاء الدبلوماسي والحماية السياسية والدعم العسكري والاقتصادي، قد حول هذه الإبادة الجماعية إلى جريمة جماعية يتحمل المجتمع الدولي مسؤوليتها القانونية والأخلاقية.
وتثني الوزارة على عمل المقررة الخاصة ألبانيز لما أظهرته من مهنية ونزاهة وشجاعة أخلاقية في أداء ولايتها، رغم الضغوط السياسية المستمرة وحملات التشويه التي تهدف الى إسكات الحقيقة وحماية الجناة، من خلال قلب الحقائق والترويج للادعاءات والاكاذيب التي لا صحة لها.
وتؤكد الوزارة الى أن هذا التقرير يجب ان يشكل نقطة تحول في موقف المجتمع الدولي. فالإبادة الجماعية الجارية في قطاع غزة ليست مأساة إنسانية فحسب، بل اختبار حقيقي لقدرة النظام الدولي على صون مبادئ العدالة والمساواة وسيادة القانون. وعلى جميع الدول أن تتجاوز مرحلة الأقوال إلى مرحلة الأفعال، وأن تتخذ إجراءات ملموسة وملزمة للوفاء بالتزاماتها بموجب القانون الدولي. حيث لم يعد مقبولاً الاكتفاء بإدارة عواقب الاحتلال الإسرائيلي ونظام الفصل العنصري؛ فقد حان الوقت لإنهائهما بصورة جذرية وشاملة.
وتشير الوزارة الى ان إعلان نيويورك بشأن التسوية السلمية لقضية فلسطين والذي يشكل إطاراً واضحاً للعمل الجماعي، يهدف إلى إنهاء الإبادة الجماعية في غزة، وضمان المساءلة عن الجرائم الجسيمة بموجب القانون الدولي، والمضي قدماً نحو الاعتراف بدولة فلسطين وتجسيدها وسيادتها على حدودها الرابع من حزيران/يونيو 1967، وعاصمتها القدس الشرقية، وفي هذا الصدد تدعو الوزارة جميع الدول إلى الالتزام بتنفيذ أحكام هذا الإعلان، بما في ذلك فرض العقوبات، ووقف توريد الأسلحة، ودعم الآليات القضائية الدولية، ووقف جميع أشكال التواطؤ والدعم السياسي والعسكري والاقتصادي التي ساهم في عنجهية الاحتلال الإسرائيلي في جرائمه وانتهاكاته في ظل تفشي سياسة الإفلات من المساءلة والعقاب الدوليين.
